By letter dated June 21, 2005, the applicant has requested a `ho effect" letter <br /> from the State Historic Preservation Division. There has been no response to the request <br /> as of this writing. <br /> Possible adverse effect or imnairment of valued resources: The applicant has <br /> stated that there is no evidence to show that valued cultural, historical, natural resources <br /> and traditional or customary native Hawaiian rights are conducted on the property or <br /> being practiced in the area. Therefore, no resources or traditional and customary Native <br /> Hawaiian rights will be affected or impaired by the proposed project. <br /> Feasible actions to protect native Hawaiian rights: A condition will be included to <br /> require the applicant to cease any activities on the site and notify the Planning <br /> Department if any unanticipated azchaeological features or sites are discovered during the <br /> course of improving the site. <br /> Based on the above findings, approval of this change of zone request from Agricultural <br /> (A-Sa) to Multiple Family Residential-2,500 squaze feet (RM-2.5) zoned district would result in <br /> an appropriate land use pattern that will further benefit the general public. <br /> For your favorable consideration, amendments to the State Land Use Boundaries Map and <br /> Section 25-8-3 (North Kona Zone Map), of the County Zoning Code are transmitted. <br /> <br />
