4. Design the project's wastewater treatment system to provide adequate <br /> capacity for the University to connect to this system, in accordance with <br /> the April 16, 2004 Memorandum of Agreement, or any subsequent <br /> amendments. <br /> 5. Design all infrastructure systems within the project site to meet the <br /> development needs of the University of Hawaii on the State's adjacent <br /> parcel of land to the south." <br /> U. Within one year of the issuance of the first residential building permit for the <br /> development, the applicant shall contribute to the State Department of Education <br /> (DOE) an 8,000 square-foot building within the project site to use for a period of <br /> <br /> • twenty (20) years, subject to the following conditions: <br /> 1. No rent or common area maintenance fees will be charged to the DOE. <br /> 2. The building will be used as instructional and office space for the school <br /> complexes located in West Hawaii. <br /> 3. The building will meet DOE facility standards, with finished classrooms, <br /> workshops, and offices. <br /> 4. The applicant will collaborate with the DOE on the requirements of the <br /> building in order to develop building plans subject to DOE approval. <br /> 5. The finished building will be available to the DOE within one year of the <br /> issuance of the first residential building permit for the development. <br /> 8 <br /> <br />
