<br /> e_ <br /> ~ <br /> Grant No. C150062 02 <br /> Amendment No. 1 <br /> Page 4 of 5 <br /> Should the County cannot implement its sewer use ordinance <br /> as required in grant condition no. 14, then it should submit <br /> a schedule of corrective action. Should the County fail to <br /> meet the deadlines of the approved schedule of corrective <br /> action, EPA will withhold payments or reduce the federal <br /> share of the grant in proportion to the unused capacity of <br /> the wastewater treatment plant. In addition, federal <br /> funding is limited to the costs of a project with a design <br /> capacity not to exceed 120 gpcd, including <br /> infiltration/inflow. After review of the reevaluation, EPA <br /> will adjust the federal share of the grant in proportion to <br /> the utilization of the wastewater treatment plant. <br /> 17. The eligibility for grant participation in the funding of <br /> this project is contingent upon a user charge system which <br /> complies with 40 CFR 35.2140 and 35.2208. Failure to comply <br /> with the aforementioned EPA regulations will result in <br /> jeopardizing EPA grant participation. <br /> The County shall submit the following to the Hawaii <br /> Department of Health (DOH) for annual review: <br /> a. A copy of the notification sent to the users which <br /> indicates the user charge rate and that portion of <br /> the charges and/or ad valorem taxes which is <br /> earmarked for wastewater services. <br /> b. A copy of the notification sent to owners of <br /> property requiring connection to completed <br /> collector sewers, <br /> 18. The County will conduct a user charge system study to <br /> determine the monthly sewer fee required for the operation <br /> and maintenance, and replacement (OM&R) costs of the <br /> facility. In addition, the study shall address EPA's <br /> comments as expressed in our letter to the Hawaii Department <br /> of Health dated March 25, 1991, including: <br /> - An evaluation of how the monthly sewer fee is <br /> determined. To comply with EPA requirements, the <br /> monthly service fees of a particular class should be <br /> determined by distributing the OM&R costs for all <br /> wastewater treatment plants (WWTPs) within the <br /> grantee's jurisdiction in proportion to the use of the <br /> WWTPs by the user class. <br /> <br />
