Rehab did plant podocarpus which are doing very well and <br />effectively screen most of the boundary behind Mrs. Gushiken's. Three <br />plants did die after being pruned to a bare trunk several years after <br />they were planted and have not been replaced. The garbage collection <br />continued as cited until I spoke to Business Services and they <br />accommodated our request which has been generally followed over the <br />years. (Exhibit 25) <br />L: - :_ • ~ ~ <br />On January 16, 2006, Martin Luther King's Birthday holiday, the <br />parking lot opened on the "subject property". Since the County offices <br />were on holiday, I contacted our Councilperson Donald Ikeda and <br />apprised him of the situation. He said that he would initiate an inquiry <br />the following day and asked that I also follow up. I checked with <br />Planning and Real Property and the lot remained zoned RS 7.5. I then <br />spoke to Robert Usagawa, Zoning Inspector and apprised him of the <br />violation. He said he would investigate. I also discussed the entire <br />problem with the County's Executive Director Andy Levin and informed <br />him of our lack of resolution over the years. He said that he would <br />look into the matter with Planning. <br />Subsequently, both AOAO and Rehab were issued citations In March, <br />2006, for non-compliance with landscaping and access conditions of <br />Ord. 95-33. They appealed the citations and continued to operate the <br />illegal parking lot until November 13, 2006 when they agreed to shut it <br />down. The resulting Board of Appeals actions are covered by Planner <br />Jeff barrow's background report for Planning on page 2 <br />"...BACKGROUND INFORMATION, SECTIONS 7 AND 8." Planning <br />has all literature associated with the Board of Appeals' hearings. <br />I do not find any reference in Ms. Song's rezoning request as to how <br />they will address the non-existent "No Vehicular Access Planting <br />Screen" that was to be plotted and installed by condition of the Final <br />Subdivision Approval issued by Planning on July 9, 1997 jExhibit 231. <br />Ms. Nancy Cabral has stated repeatedly that nothing was ever planted <br />across the °subject property's" boundary with PPB/Rehab since it was <br />their property and they deemed the plantings unnecessary.
