<br /> against all claims and demands for loss or damage, including without limitation, property <br /> damage, personal injury and wrongful death, arising out of or in connection with the use or <br /> occupancy of the premises by County, or by any other person claiming under it, or any accident, <br /> fire or nuisance on the premises or any failure by County to keep the premises in a safe <br /> condition, and County will reimburse Landlord for all its costs and expenses, including without <br /> limitation, all attorneys' fees incurred in connection with the defense of any such claims, and <br /> will hold all goods, materials, furniture, fixtures, equipment, machinery and other property <br /> whatsoever on or in the premises at the sole risk of County and hold Landlord harmless from and <br /> against all loss or damage thereto by any cause whatsoever, including without limitation, loss or <br /> damage resulting from any discharge or leaking of water into the premises or from any conduits <br /> or facilities therein. <br /> 26. Surrender. At the end of the term or other sooner determination of this lease, <br /> County will peaceably deliver up to Landlord possession of the premises, together with all <br /> improvements within, upon or belonging to the same by whomsoever made, in good repair, order <br /> and condition, except for reasonable wear and tear and as otherwise expressly provided herein; <br /> provided, however, that if County is not in default hereunder, it may then remove any trade <br /> fixtures installed by it in the premises but shall repair promptly to Landlord's satisfaction all <br /> damage caused by such removal. <br /> 27. Default. This demise is on this condition, that if County then holding this <br /> lease (1) shall fail to pay the said rental or any part thereof when the same becomes due, whether <br /> <br /> the same shall or shall not have been legally demanded, and such failure shall continue for a <br /> period of ten (10) days after written notice of default to County, or (2) shall fail to observe or <br /> <br /> perform faithfully any of the other covenants or agreements herein contained and on the part of <br /> 11 <br /> <br />
