<br /> November 6, 2007 <br /> Page 2 <br /> mining, dredging, filling, stockpiling, grading, paving, excavation or drilling <br /> operations or storage of equipment or materials." <br /> "[(23j] "Floodplain administrator" is the individual appointed to administer and <br /> enforce the floodplain management regulations. This person shall be the director <br /> of public works of the County of Hawaii or the director's duly authorized <br /> representative who shall be a currently licensed professional engineer in the <br /> State of Hawaii " <br /> "Floodplain management regulations" means zoning ordinances, <br /> subdivision regulations, building codes, health regulations, and special purpose <br /> ordinances such as a floodplain ordinance or an erosion and sedimentation <br /> control ordinance) and other applications of police cower. The term describes <br /> such federate state or local regulations, in any combination thereof, which <br /> provide standards for the pumose of flood damag~revention and reduction." <br /> "[(3A)] "Fraud and victimization" related to article 5, variances, of this chapter <br /> means that the variance granted must not cause fraud on or victimization of the <br /> public. In addition, <br /> future owners may purchase the structure(s), unaware that it is <br /> subject to potential flood damage, and the structure(s) can be insured only at <br /> very high flood insurance rates." <br /> "[(~3~] "Riverine" means relating to, formed by, or resembling a river (including <br /> tributaries), stream, brook, etc. whether intermittent or perennial." <br /> 3. SECTION 9 Amends section 27-16 <br /> Bill 151 D2 was changed by amending the following paragraphs: <br /> A) Pages 15-16 Paragraphs 27-16(1)(C) - (D) were amended as follows: <br /> "[(3j] ~ All permits and proposals shall be reviewed to determine that the <br /> proposed building site is reasonably safe from flooding;[aud] <br /> For proposed building sites in flood-prone areas where special flood <br /> hazard areas have not been defined, water surface elevations have not <br /> been provided, and there is insufficient data to identify the floodwav or <br /> coastal high hazard areas but the flood plain administrator has <br /> determined that there are indications that such hazards are present, all <br /> new construction, improvements to repetitive loss structures and <br /> <br />
