[(38j] "Structure" means a walled and roofed building, including a gas or liquid <br /> <br /> storage tank, that is principally above ground, as well as a manufactured home. <br /> [(39~] "Substantial damage" means damage of any origin sustained by a structure <br /> <br /> whereby the cost of restoring the structure to its before damaged condition would <br /> <br /> equal or exceed fifty percent of the market value of the structure before the <br /> <br /> damage occurred. <br /> [(~9j] "Substantial improvement." For the purposes of this chapter, the <br /> determination of whether any improvements constitute substantial improvements <br /> is applicable only to structures built prior to May 5, 1982 or buildings constructed <br /> after May 5, 1982 which were not within a special flood hazard area at the time of <br /> issuing the building permit. "Substantial improvement" means any repair, <br /> <br /> reconstruction, rehabilitation, addition, or other proposed new development of a <br /> structure, the cost of which equals or exceeds fifty percent of the market value of <br /> <br /> the structure before the "start of construction" of the improvement which shall be <br /> the sum of all costs of all such work performed in the previous [il3ree] ten years <br /> including the cost of the current work being considered. The value of the structure <br /> includingprevious 10 year improvements, shall be certified by a contractor, <br /> engineer, or architect licensed by the State and the-property owner as maw <br /> required on a form provided by the County. This term includes structures which <br /> have incurred "substantial damage," regardless of the actual repair work <br /> performed. The term does not, however, include either; <br /> [(~j] ~ [airy] ~ project for improvement of a structure to correct existing <br /> violations of state or local health, sanitary, or safety code <br /> specifications which have been identified by the local code <br /> enforcement official and which are the minimum necessary to assure <br /> safe living conditions; or <br /> [(-1~] ~ [arry] ~ alteration of a "historic structure," provided that the <br /> alteration will not preclude the structure's continued designation as a <br /> "historic structure." <br /> [(~1-j] "Variance" means a grant of relief from the requirements of this chapter <br /> which permits construction in a manner that would otherwise be prohibited by this <br /> chapter. <br /> "Violation" means the failure of a structure or other development to be <br /> fully compliant with the community's floodplain management regulations. A <br /> structure or other development without the elevation certificate, other <br /> certifications, or other evidence of compliance with this chapter is presumed to be <br /> in violation until such time as that documentation is provided. <br /> "Water surface elevation" means the height, in relation to the National <br /> Geodetic Vertical Datum of 1929, (or other datum, where specified) of floods of <br /> various magnitudes and frequencies in the floodplains of coastal or riverine areas. <br /> [(~33] "Watercourse" means a lake, river, creek, stream, wash, arroyo, channel, <br /> or other topographic feature on or over which waters flow at least periodically. <br /> Watercourse includes specifically designated areas in which substantial damage <br /> may occur. <br /> [(~4j] "Zone A" is the special flood hazard area that corresponds to the <br /> one-hundred-year floodplains that are determined in the Flood Insurance Study by <br /> 11 <br /> <br />
