After some measure of <br /> consideration, the request was referred to your office by the Council for some technical <br /> <br /> update. <br /> "Since the subject ordinance became effective on September 9, 1991, the County has <br /> <br /> articulated policies relating to matters such as no ohana covenants, incremental <br /> developments, infrastructural requirements, and the like through the adoption of <br /> <br /> rezoning ordinances within the County. These policies reflect the County's concern for <br /> the welfare of the broader community, as well as making requirements reasonable and <br /> <br /> equitable. <br /> <br /> "As such, rather than continuing to pursue only a time extension, the applicant believes <br /> it prudent to submit and have the County consider a request that attempts to more <br /> <br /> comprehensively address prevailing development and zoning policies. It is in that spirit <br /> that the applicant makes this request." <br /> <br /> NATURE OF REQUEST <br /> 111. Incremental Zoning and Construction Timetable <br /> <br /> Conditions C through H relate to the construction timetable for the single- <br /> family, multiple-family, and commercially zoned areas. More specifically: <br /> <br /> • Condition C required that the single-family portion be developed in two <br /> increments, with actual housing construction performance requirement <br /> being the 'trigger' for the second increment; <br /> <br /> • Condition D required the submittal of subdivision plans within a year of <br /> zoning approval and final approval secured within a year after tentative <br /> subdivision approval; <br /> <br /> • Conditions E & F required the submittal of plans for Plan Approval for <br /> the multiple family residential zoned area within two years of zoning <br /> approval and their construction within three years thereafter; and <br /> <br /> • Condition G, & H required the submittal of plans prior to receipt of final <br /> subdivision approval of the second increment and construction for the <br /> <br /> <br /> -3- <br />
