Project Site Photos <br />Attachment 2 consists of the Construction Plans; Attachment 3 of the Maintenance Plan, and <br />Attachment 4 of the Environmental Assessment. <br />CONSERVATION DISTRICT REQUIREMENTS <br />Demonstrate that the proposed use is consistent with the following criteria. Refer to HAR, <br />Section 13-5-30, to review criteria. Attach additional sheets if necessary. <br />Is the proposed land use consistent with the purpose of the Conservation District? <br />HAR, Section 13-5-30, specifies the following consistency criteria, which we list here, along <br />with a discussion of the project's conformance with each. <br />1. The proposed land use is consistent with the purpose of the Conservation District. The <br />intended identified use is a Public Purpose use under HAR Title 11 (see below) and is beneficial <br />to the community and not detrimental to the environment. It is thus consistent with the objectives <br />of the Conservation District. <br />2. The proposed land use is consistent with the objectives of the subzone of the land on which the <br />use will occur. The objective of the General subzone is to designate open space where specific <br />conservation uses may not be defined, but where urban use would be premature. Use for an <br />emergency road does not detract from this objective. This is discussed in detail below. <br />3. The proposed land use complies with provisions and guidelines contained in Chapter 205A, <br />Hawaii Revised Statutes (HRS), entitled "Coastal Zone Management,"where applicable. The <br />expected consistency of the project with the SMA rules is discussed in Section 3.6.4 below. As <br />part of the Draft EA review, the Planning Department will also evaluate the SMA Assessment. <br />The applicant expects that Planning will determine that the project is consistent with SMA <br />objectives and will grant an SMA Minor Permit. Applicant will provide copy of Planning <br />Department determination to DLNR as soon as it is made. <br />4. The proposed land use will not cause substantial adverse impact to existing natural resources <br />within the surrounding area, community or region. Because of the relatively minor nature of the <br />project and the lack of native terrestrial ecosystems, threatened or endangered plant species, or <br />affected water bodies, construction and use of the project corridor for an emergency road would <br />not adversely impact natural resources. The project is located over 300 feet from the shoreline <br />and no effect on any coastal ecosystem will occur. The precautions for preventing any effects to <br />water quality during construction should prevent any adverse impact on aquatic biological <br />resources in coastal waters. <br />Conservation District Use Application, Puako Emergency Road <br />4 <br />
