<br /> <br /> <br /> „YY Ol y <br /> <br /> COUNTY OF HAWAII STATE OF HAWAII <br /> <br /> ~i~r~•,, jO~,Nr <br /> <br /> BILL NO. 28 <br /> ORDINANCE NO. <br /> <br /> AN ORDINANCE DESIGNATING TMK (3) 4-8-004:006 AS THE "WAIPI`O <br /> COMMUNITY PARK," PURSUANT TO CHAPTER 15, ARTICLE 8, SECTION 15-67 <br /> OF THE HAWAII COUNTY CODE 1983 (2005 EDITION AS AMENDED); AND <br /> AMENDING CHAPTER 15, ARTICLE 8, SECTION 15-68.1 OF THE HAWAII <br /> COUNTY CODE 1983 (2005 EDITION, AS AMENDED), TO ADD THE "WAIPI`O <br /> COMMUNITY PARK" TO THE PARKS AND RECREATIONAL FACILITIES <br /> SCHEDULE. <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br /> <br /> SECTION 1. The purpose of this ordinance is to designate this parcel as a new park <br /> under the County of Hawaii Department of Parks and Recreation for passive use while the <br /> community determines its vision for the long term use of this property. The parcel, formerly <br /> known as the "Rice property," was acquired by the county pursuant to the provisions of chapter <br /> 2, article 42, Hawaii County Code, the Public Access, Open Space, and Natural Resources <br /> Preservation Fund. <br /> <br /> <br /> SECTION 2. Pursuant to chapter 15, article 8, section 15-67(a)(2)(A), Hawaii County <br /> Code 1983 (2005 Edition, as amended), the approximately 1.8 acre property situated at TMK (3) <br /> 4-8-004:006 is hereby designated as the "Waipi`o Community Park." <br /> <br /> <br /> SECTION 3. Chapter 15, article 8, section 15-68.1, Hawaii County Code 1983 (2005 <br /> Edition, as amended), is amended by adding the following facility to the Hilo/Hamakua parks <br /> and recreational facilities schedule, to be appropriately inserted and to read as follows: <br /> <br /> "Waipi`o Community Park" <br /> <br /> SECTION 4. Severability. If any provision of this ordinance or the application thereof <br /> to any person or circumstance, is held invalid, the invalidity does not affect other provisions or <br /> applications of the ordinance which can be given effect without the invalid provision or <br /> application, and to this end the provisions of this ordinance are severable. <br /> <br /> <br /> SECTION 5. New material is underscored. In printing this ordinance, the underscoring <br /> need not be included. <br />
