The law requires USDOL to obligate the ARRA funds to SCSEP grantees within 30 days of its <br />enactment or no later than March 19, 2009. In addition, grantees must in turn obligate its ARRA <br />funds to SCSEP operators within 30 days of receipt. This short time frame does not allow the <br />State sufficient time to issue and procure SCSEP operators under ARRA through a Request for <br />Proposal process. To comply with the State procurement rules, DLIR has submitted a Request <br />for Exemption from Chapter 103F, HRS, to the State Procurement Office. A Request for <br />Information has also been prepared soliciting expressions of interest. <br />POLICY <br />Grantees and operators are expected to adhere to the current statutory and regulatory <br />requirements for SCSEP as contained in the following: <br />• 2006 Older Americans Act (OAA) Amendments, Public Law 109-365; <br />• SCSEP Performance Accountability Interim Rule, 20 CFR Part 641, Subparts A and G, <br />72 Federal Register 36832 (June 29, 2007); <br />• SCSEP Final Rule 20 CFR Part 642 (Apri19, 2004); <br />• Priority of Service for Covered Persons: Final Rule 20 CFR Part 1010, 73 FR 78132 <br />(December 19, 2008); and <br />• The American Recovery and Reinvestment Act of 2009, PL 111-05, Division A, <br />Title VIII. <br />Accountability and transparency are key components of the ARRA. Recipients of ARRA <br />SCSEP funds must: <br />• Provide SCSEP services in the same counties/geographic areas as currently authorized; <br />• Recruit and enroll new participants according to the SCSEP eligibility rules; <br />• Assign participants among subprojects in accordance with the PY 08 equitable <br />distribution formula to the extent feasible; <br />• Recruit new host agencies or expand opportunities at existing host agencies; <br />• Protect against maintenance of effort violations; <br />• Track ARRA participation and document activities using the SCSEP Performance and <br />Results QPR (SPARQ) data collection and performance reporting system; and <br />• Track ARRA funds separately from regular SCSEP grant funds and submit all required <br />financial reports in a timely manner as determined by USDOL in accordance with the <br />ARRA. <br />In addition, to the extent feasible, emphasis should be placed in training participants in areas of <br />high growth industries such as health care, child care, education, green jobs, energy efficiency, <br />and environmental services. <br />While it is expected that performance under the ARRA will be utilizing the same performance <br />measures, it is anticipated that separate goals will be issued for the ARRA funds. It is also <br />anticipated that the reporting requirements under the ARRA will need to be more frequent than <br />-2- <br />
