DECISION AND ORDER <br />IT IS HEREBY ORDERED that the Property being the subject <br />of this Docket No. A93-701 filed by Petitioner, Kaupulehu <br />Developments, consisting of approximately 1,009.086 acres of land <br />in the State Land Use Conservation District at Ka`upulehu, North <br />Koda, Island, County, and State of Hawai i, identified as Tax Map <br />Key No. 7-2-03: por. 1, and approximately shown on Exhibit "A" <br />attached hereto and incorporated by reference herein, is hereby <br />reclassified into the State Land Use Urban District, and the <br />State land use district boundaries are amended accordingly, <br />subject to the following conditions: <br />1. Petitioner shall provide affordable housing <br />opportunities for low, low -moderate, and gap group income <br />residents in the State of Hawaii to the satisfaction of the <br />County of Hawaii. The location and distribution of the <br />affordable housing or other provisions for affordable housing <br />shall be under such terms as may be mutually agreeable between <br />Petitioner and the County of Hawaii. <br />2. Petitioner shall implement effective soil erosion <br />and dust control measures during construction to the satisfaction <br />of the State Department of Health and the County of Hawaii. <br />3. Petitioner shall develop a solid waste management <br />plan in conformance with the Integrated Solid Waste Management <br />Act, Chapter 342G, Hawaii Revised Statutes. Petitioner's solid <br />waste management plan shall be approved by the County of Hawaii <br />Department of Public Works. <br />-37- <br />
