COUNTY OF HAWAII <br />RESOLUTION NO. <br />STATE OF HAWAII <br />166 09 <br />RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL YEAR AND OF <br />MORE THAN ONE FISCAL YEAR FOR SIX (6) 75 CUBIC YARD REFUSE TRAILERS <br />WHEREAS, Section 10-11 of the County Charter requires that any contract, lease or other obligation <br />requiring payment of funds from the appropriations of a later fiscal year or more than one fiscal year be <br />approved by resolution; and <br />WHEREAS, the County is in need of six (6) 75 cubic yard refuse trailers to replace some of their 1996 <br />Brothers 75 cubic yard trailers that are reaching the end of their useful lives and are incurring costly mechanical <br />and structural repairs; and <br />WHEREAS, the trailers to be replaced are worn down due to their daily use to haul refuse from the <br />transfer stations to either East or West Hawaii landfill; and <br />WHEREAS, the County wishes to enter into a five (5) year contract to lease with purchase options for six <br />(6) 75 cubic yard refuse trailers for solid waste operations. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the <br />Mayor is hereby authorized to enter into a five (5) year lease agreement with purchase options for the <br />acquisition of six (ti) 75 cubic yard refuse trailers for solid waste operations and that sufficient funds be budgeted <br />in future fiscal years to cover the anticipated obligations of the County under the terms of the agreement. <br />BE IT FURTHER RESOLVED that the Clerk transmit copies of this resolution to the Mayor's Office and the <br />Departments of Finance and Environmental Management. <br />Dated at Hilo ,Hawaii, this 2nd day of June , 2009. <br />INTR UCED BY: <br />Uw-~-~ <br />COUNCIL MEMBER, C NT HAWAII <br />COUNTY COUNCIL <br />County of Hawaii <br />Hilo, Hawaii <br />I hereby certify that the foregoing RESOLUTION was by the <br />vote indicated to the right hereof adopted by the COUNCIL, of the <br />County of Hawaii on June 2, 2009 <br />ATTEST <br />~~----~~ <br />ROLL CALL VOTE <br /> AYES NOES ABS EX <br />ENRIQUES X <br />FORD X <br />GREEN WELL X <br />HOFFMANN X <br />IKEDA X <br />NAEOLE X <br />ONISHI X <br />YAGONG X <br />YOSHIMOTO X <br /> 9 0 0 0 <br />Reference C-335/FC-64 <br />COUNTY CLERK CHAIRPERSON & PRESIDING OFFICER RESOLUTION NO. <br />166 09 <br />
