The <br /> applicant will be required to complete the necessary transmission and storage facilities. <br /> The DWS is currently reviewing construction plans for the installation of a 16-inch <br /> waterline to be placed within a private waterline easement within the subject parcel. <br /> Water will be made available from the new 16-inch waterline after all.water system <br /> improvements have been completed in accordance with the agreement. <br /> The project will connect to the County sewerline after the approval of a Sewer <br /> Extension application by the Department of Environmental Management. All essential <br /> utilities are available to the property. <br /> The subject request is not contrary to Chapter 205A, Hawaii Revised <br /> Statutes, relating to Coastal Zone Management Area. The property is located mauka <br /> of the Queen Ka`ahumanu Highway and not within the Special Management Area. As <br /> such, the project site will not be impacted by coastal hazard and beach erosion. There are <br /> no identified recreational resources, public access to the shoreline or mountain areas, <br /> designated scenic and open space preserves, coastal ecosystems, marine resources or <br /> other natural and environmental resources in the immediate project area. Thus, the <br /> proposed request and use of the property will not adversely impact those resources. <br /> An Archaeological Inventory Survey was prepared by Rechtman Consulting, LLC ' <br /> and submitted to the DLNR-HPD on November 30, 2005. The survey was approved by <br /> the DLNR-HPD on October 4, 2006. In a letter dated June 15, 2009, the DLNR-HPD <br /> stated that no historic properties will be affected because "SHPD previously reviewed this <br /> project and mitigation has been completed." <br /> In view of the Hawaii State Supreme Court's "PASH" and "Ka Pa'akai O <br /> Ka'Aina"decisions, the issue relative to native Hawaiian gathering and fishing rights <br /> must be addressed. These rights must be addressed in terms of the cultural, historical, <br /> and natural resources and the associated traditional and customary practices of the site. <br /> Investigation of valued resources: An Archaeological Inventory Survey was <br /> prepared by Rechtman Consulting, LLC and submitted to the DLNR-HPD on <br /> November 30, 2005.
