<br />1 <br /> <br />, <br />I <br />,,) <br /> <br />BHiBrewREZ.doc-l1/16/09 <br /> <br />COUNTY OF HAW AI'I PLANNING DEPARTMENT <br />BACKGROUND REPORT <br /> <br />HAW An BREWERY DEVELOPMENT CO., INC. <br />CHANGE OF ZONE APPLICATION (REZ 09-107) <br /> <br />HAW An BREWERY DEVELOPMENT CO., INe. requests a Change of Zone from <br />an Agricultural 5-acre (A-5a) to a Family Agricultural2-acre (F A-2a) district for approximately <br />7.829 acres ofland. The property is located east of Highway 11 (Volcano Highway) and north <br />of Highway 130 (Kea'au-PahoaHighway), Kea'au, Puna, Hawaii, TMK: 1-6-141: 24. <br />PROPOSED ACTION <br />1. Request: Change of Zone for 7.829 acres ofland from an Agricultural5-acre (A-5a) to a <br />Family Agricultural 2-acre (F A-2a) district. (Planning Department Exhibit 1 - Change <br />of Zone application) <br />2. Background and Reasons for the Request: The original 14.5-acre parcel was rezoned <br />from A-20a to A-5a under Ordinance No. 0421, effective February 25,2004. The <br />applicant proposed to subdivide the site of the water bottling facility from the proposed <br />brewery and other components ofthe project, and applied for a 2-10t subdivision. Final <br />Subdivision Approval was granted by the Planning Director on January 11,2005. <br />However, as the approximately 7.8-acre parcel appears too large for the proposed <br />brewery and soft drink bottling facility, the applicant currently seeks a change of zone <br />from A-5a to FA-2a to subdivide the 7.8-acre parcel into 3 lots. This would potentially <br />allow different operators for the brewery and soft drink bottling facility. The applicant .... <br />states that "there is a possibility that the brewery would be split into two components. <br />One would involve a micro-brewery for beer, and the other could possibility be a distilled <br />brewery for sake." The applicant has submitted a concurrent request for a five-year <br />extension of time to amend Condition NO.5 of Special Permit No. 842 approved on May <br />27, 1993 to establish a brewery, water and soft drink bottling facility and related <br />improvements. <br /> <br />STATE AND COUNTY PLANS <br /> <br />3.
