The Honorable .l Yoshimoto, Chairman <br /> and Members of the County Council <br /> Page 4 <br /> requirements of Chapter 27, Floodplatn Management, of the Hawm'i County Code for <br /> construction within the "AE" flood zone and buffer zone which specifies, among other <br /> things, mununum building elevation requirements. <br /> County water is available from existing 8-inch and 6 -inch waterlines fronting the <br /> property along Ponahawai Street. However, these waterlines are not capable of providing <br /> the required 2.000 gallons per minute of water flow for frrc protection for commercial <br /> land uses. The Department of Water Supply recommends that the applicant install an <br /> additional waterline within Ponahawai Street or implement an alternative method <br /> acceptable to the Fire Department in order to meet the minimum water flow requirement <br /> for lire protection. The proposed request would also require the installation of a reduced <br /> pressure type backflow prevention assembly within five feet of the existing water meter <br /> or any additional water meters. Conditions of approval will be included to address the <br /> Department of Water Supply's requirements. <br /> The property is currently not serviced by the County sewer system. The applicant <br /> proposes to dispose of wastewater by a septic system meeting the requirements of the <br /> Department of Health until a public sewer line is extended to the properties frontage <br /> along Ponahawai Street. Solid waste will he disposed of by private contractor to the Hilo <br /> Landfill or other site designated by the Department of Environmental Management. <br /> Electrical and telephone services are available to the property. Police, fire and medical <br /> services are available less than two smiles from the property. <br /> The request is not contrary to Chapter 205A, Hawaii Revised Statutes, <br /> relating to the Coastal Zone Management Area. The subject property is located over <br /> one mile from the shoreline at an elevation of about 240 feet above sea level and is not in <br /> the Special Management Arca. Theretbre. the property will not be impacted by coastal <br /> hazards or affect beach erosion, coastal recreational resources, coastal ecosystems and <br /> marine resources. <br /> In view of the Hawaii State Supreme Court's "PASH" and "Ka Pa'akar 0 <br /> Ka 'Al na "decisions, the issue of native I lawaiian gathering and fishing rights must he <br /> addressed in terms of the cultural, historical, and natural resources and the associated <br /> traditional and customary practices of the site: <br /> • investigation of valued resources: No formal archaeological reconnaissance <br /> survey. oral history of kama aina accounts of the area. historical survey of <br /> documentary records. or botanical study was included in the application. <br />
