The I lonorable J Yoshimoto, Chairman <br /> and Members of the County Council <br /> Page 5 <br /> • The valued cultural, historical. and natural resources found in the rezoning area' <br /> The property has been used for the cultivation of sugarcane in the past and was <br /> recently grubbed. According to the applicant. no valued cultural, historical or <br /> natural resources exist on the property and there is no evidence of any traditional <br /> and customary Native Hawaiian rights being practiced on the property. As such, it <br /> is anticipated that no cultural, historic or natural resources will be affected. In a <br /> letter dated April 1, 2009, the DLNR -SHPD stated that no historic properties will <br /> he affected by the proposed development <br /> • Possible adverse effect or impairment of valued resources. Native plants may be <br /> destroyed by ground alteration. There is no evidence that the flora in the area are <br /> particularly desired or used for cultural practices. <br /> • Feasible actions to protect native Hawaiian rights: As stated by the applicant. no <br /> gathering is taking place on the site. Thus, to the extent to which traditional and <br /> customary native Hawaiian rights are exercised, the proposed action will not <br /> affect traditional Hawaiian rights; therefore, no action is necessary to protect these <br /> rights A condition of the change of zone will require that the applicant cease <br /> work and notify the SHPD should any unanticipated archaeological features or <br /> sites be uncovered during the course of development. <br /> Based on the above findings, the request to reclassify the property from an <br /> Agricultural - 1 -acre (A -1 a) to a Neighborhood Commercial - 20,000 - square foot (CN -20) <br /> zoned district would result in an appropriate land use pattern that would further benefit <br /> the general public. <br /> For your favorable consideration, an amendment to Section 25-8-33 (City of Hilo Zone Map) of <br /> the County Zoning Code is transmitted. <br />
