WHEREAS, Agency has reviewed Grantee's application for <br />funds, and is satisfied that all of the requirements of the Act <br />and Recovery and their respective implementing regulations have <br />been satisfied and that Grantee is capable of using the federal <br />funds requested appropriately; <br />WHEREAS, Grantee has demonstrated the capacity to <br />provide the services, programs and activities described herein <br />and is ready, willing and able to provide the required services, <br />programs and activities; <br />NOW THEREFORE, Agency and Grantee for and in <br />consideration of the covenants, conditions, agreements, and <br />stipulations hereinafter expressed, do mutually agree as <br />follows: <br />A. SCOPE OF SERVICES <br />Grantee shall, in a proper and satisfactory <br />manner, as determined by Agency, and in accordance with the <br />terms and conditions of this Contract, use the funds received <br />under this Contract for the purposes stated herein and in <br />accordance with the "Application For Grant" (Parts I through IV <br />including all certifications required under Section C and the <br />Revised 8/09 3 <br />
