J + � \ N ,1 �� •,• <br /> COUNTY OF HAWAII •: / •I ST OF HAWAII <br /> RESOLUTION NO. 379 10 <br /> RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER <br /> INTO AN AGREEMENT WITH THE STATE OF HAWAII DEPARTMENT <br /> OF THE ATTORNEY GENERAL, PURSUANT TO HRS 46 -7, FOR AN <br /> ENFORCEMENT OF PROTECTIVE ORDERS AND TEMPORARY <br /> RESTRAINING ORDERS (TRO) GRANT FOR THE HAWAII POLICE <br /> DEPARTMENT <br /> WHEREAS, the State of Hawaii Department of the Attorney General, Crime <br /> Prevention and Justice Assistance Division has authorized funding for an Enforcement of <br /> Protective Orders and Temporary Restraining Orders (TRO) grant for the Hawaii Police <br /> Department; and <br /> WHEREAS, there has been an increase in the number of reported cases of <br /> domestic violence incidents in Hawaii County which has led to a substantial increase in <br /> the amount of protective orders being processed and subsequently issued; and <br /> WHEREAS, the goal of this project is to improve Hawaii Police Department's <br /> ability to ensure prompt service of all protective orders, including those in which a <br /> respondent is a convicted felon or falls under the Lautenberg Act and are thus prohibited <br /> from possessing firearms and or ammunition; and <br /> WHEREAS, the expeditious service of protective orders and seizure of firearms <br /> from restrained respondents will significantly affect the level of protection afforded <br /> victims of domestic violence; and <br /> WHEREAS, this grant provides the funding for overtime to allow officers the <br /> necessary time to serve these orders; and <br /> WHEREAS, the funds provided by the State of Hawaii Department of the Attorney <br /> General are derived from grants provided by the federal government; and <br /> WHEREAS, Hawaii Revised Statutes, Section 46 -7, requires that county <br /> departments obtain the consent of the council to enter into agreements with the federal <br /> or state governments respecting action to be taken pursuant to any of the powers <br /> granted by law to furnish, expend, and receive any funds or other assistance in <br /> connection with projects being or to be undertaken pursuant to those powers. <br />
