WHEREAS, the 21.30 acre parcel is located on a main road making it an easy place for <br /> the public to access (not a long hike), and there is a gradual entrance into the water making it <br /> especially safe for the keiki; and <br /> WHEREAS, an ocean accessed swimming hole replenished by moving, fresh water <br /> makes it a more fun, naturally beautiful, and different environment compared to a chlorinated <br /> swimming pool; and <br /> WHEREAS, the County of Hawai`i would like to enter into negotiations for a <br /> ninety -nine (99) year lease and /or Memorandum of Agreement (MOA) with Ku'ulei Kealoha <br /> Cooper Springer for 21.30 acres of her Pohoiki coastal property, in order to create this public <br /> swimming area; and <br /> WHEREAS, a negotiated lease agreement and /or MOA will be subject to obtaining the <br /> necessary external funding to construct the public swimming area; now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the <br /> administration of the County of Hawai`i is authorized to enter into negotiations for a ninety -nine <br /> (99) year lease and /or Memorandum of Agreement (MOA) with Ku'ulei Kealoha Cooper <br /> Springer to lease 21.30 acres of land, identified as TMK: (3)1 4- 002:009, to create a public <br /> swimming area in the Pohoiki area. <br /> BE IT FURTHER RESOLVED that, pursuant to Section 10 -11 of the Hawai`i County <br /> Charter, which requires that any contract, lease or other obligation requiring payment of funds <br /> from the appropriations of a later fiscal year or of more than one fiscal year shall be approved by <br /> resolution, a subsequent resolution containing the negotiated terms shall be submitted to the <br /> council for its consideration. <br /> 2 <br />
