<br />RESOLUTION AUTHORIZING THE ACCEPTANCE OF THE DONATION OF LOT 8,
<br />SITUATED AT THE SOUTHWEST SIDE OF KAILUA - KEAUHOU BEACH ROAD, AT
<br />KAHULUI 1ST, DISTRICT OF NORTH KONA, COUNTY AND STATE OF HAWAII,
<br />BEING TAX MAP KEY: (3)7 -5- 019 -025, FROM WENDELL KWAI SUNG FOO, TRUSTEE
<br />OF THE FOO 1980 TRUST AGREEMENT, AND SUE LING FOO, TRUSTEE OF THE FOO
<br />1980 TRUST AGREEMENT, AND A PORTION OF L.C.A. 7713, APANA 43, COUNTY
<br />AND STATE OF HAWAII, BEING TAX MAP KEY: (3)7 -6- 017 -083, FROM WENDELL
<br />K.S. FOO
<br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII:
<br />WHEREAS, Wendell Kwai Sung Foo, Trustee of the Foo 1980 Trust Agreement, and
<br />Sue Ling Foo, Trustee of the Foo 1980 Trust Agreement, are the owners of Lot 8, situated at the
<br />southwest side of Kailua - Keauhou Beach Road, at Kahului 1st, District of North Kona, County
<br />and State of Hawai`i, identified as being Tax Map Key: (3)7 -5- 019 -025, consisting of 2,520 sq.
<br />ft., delineated on Exhibit "A" attached hereto; and
<br />WHEREAS, Wendell K.S. Foo is the owner of a portion of L.C.A. 7713, Apana 43,
<br />County and State of Hawai`i, identified as being Tax Map Key: (3)7 -6- 017 -083, consisting of
<br />0.19 acres, delineated on Exhibit "B" attached hereto; and
<br />WHEREAS, the County of Hawai`i requested and Wendell Kwai Sung Foo, Trustee of
<br />the Foo 1980 Trust Agreement, and Sue Ling Foo, Trustee of the Foo 1980 Trust Agreement,
<br />agreed that Tax Map Key: (3)7 -5- 019 -025 be donated for use in the Ali`i Drive Culvert
<br />Replacement Project; and
<br />WHEREAS, Wendell K.S. Foo also wishes to donate Tax Map Key: (3)7 -6- 017 -083 to
<br />the County of Hawai`i for public purpose; and
<br />WHEREAS, such donations have been approved by the Planning Department,
<br />Department of Public Works, Department of Water Supply, and the Real Property Tax Division;
<br />and
<br />WHEREAS, Article XIII, Section 13 -12 of the Hawai`i County Charter provides that the
<br />Council, on behalf of the County of Hawai`i, may accept gifts or donations of real property.
