No. 383/Res. 166 -11 Your Committee on Finance, to which was referred Resolution No. 166 -11, reports as follows: Resolution No. 166 -11, transmitted by Director of Finance Nancy Crawford via Communication No. 383 dated September 22, 2011, authorizes the Mayor to enter into an agreement with the State of Hawai `i, Board of Land and Natural Resources, Legacy Land Conservation Commission, and to accept funds for the acquisition of three parcels of land at Kaiholena, District of North Kohala, Island of Hawaii. The Tax Map Key(s): 5 -8 -01: 021, 5 -8 -01: 022 and access parcel 5 -8- 01:025. The Hawai`i County Public Access, Open Space and Natural Resources Preservation Commission cited Kaiholena as a site where there are "Lands or property entitlements with high public interest, imminent needs for acquisition, and largest benefit to the general public." Resolution No. 644 -08, passed by the County Council on June 3, 2008, authorized the Director of Finance to enter into negotiations for acquisition of the subject parcels of land in the area collectively known as Kaiholena, in the District of North Kohala. On September 16, 2010, the County of Hawai`i, applied for funding by grant from the State of Hawai`i, Department of Land and Natural Resources, Legacy Land Conservation Commission, for the acquisition of Kaiholena, Tax Map Key parcels 5- 89 -01: 021, 022 and access Parcel 025 comprising of 76.615 acres. The Legacy Land Conservation Commission approved the County's application and granted the amount of $1,650,000, which the Board of Land and Natural Resources approved on February 11, 2011. Pursuant to Section 46 -7, Hawaii Revised Statutes, County Departments must obtain the consent of the Council to enter into agreements with the federal or state governments respecting action to be taken pursuant to any of the powers granted by law to furnish, expend and receive any funds or other assistance in connection with projects being or to be undertaken pursuant to those powers. Your Committee Members Hoffmann and Pilago commented on their attendance last month with other dignitaries in the dedication of these parcels.
