REPORT OF THE <br />COMMITTEE ON FINANCE <br />DATE: October 4, 2011 <br />PLACE: Council Chambers <br />Hilo, Hawai <br />TIME: 1:37 p.m. <br />Council Chair and Members <br />Hawai`i County Council <br />Hilo, Hawaii 96720 <br />Re: Comm. No. 383/Res. 166 -11 <br />Your Committee on Finance, to which was referred Resolution No. 166 -11, reports as follows: <br />Resolution No. 166 -11, transmitted by Director of Finance Nancy Crawford via Communication <br />No. 383 dated September 22, 2011, authorizes the Mayor to enter into an agreement with the <br />State of Hawai `i, Board of Land and Natural Resources, Legacy Land Conservation <br />Commission, and to accept funds for the acquisition of three parcels of land at Kaiholena, <br />District of North Kohala, Island of Hawaii. The Tax Map Key(s): 5 -8 -01: 021, 5 -8 -01: 022 and <br />access parcel 5 -8- 01:025. <br />The Hawai`i County Public Access, Open Space and Natural Resources Preservation <br />Commission cited Kaiholena as a site where there are "Lands or property entitlements with high <br />public interest, imminent needs for acquisition, and largest benefit to the general public." <br />Resolution No. 644 -08, passed by the County Council on June 3, 2008, authorized the Director <br />of Finance to enter into negotiations for acquisition of the subject parcels of land in the area <br />collectively known as Kaiholena, in the District of North Kohala. <br />On September 16, 2010, the County of Hawai`i, applied for funding by grant from the State of <br />Hawai`i, Department of Land and Natural Resources, Legacy Land Conservation Commission, <br />for the acquisition of Kaiholena, Tax Map Key parcels 5- 89 -01: 021, 022 and access Parcel 025 <br />comprising of 76.615 acres. The Legacy Land Conservation Commission approved the County's <br />application and granted the amount of $1,650,000, which the Board of Land and Natural <br />Resources approved on February 11, 2011. <br />Pursuant to Section 46 -7, Hawaii Revised Statutes, County Departments must obtain the consent <br />of the Council to enter into agreements with the federal or state governments respecting action to <br />be taken pursuant to any of the powers granted by law to furnish, expend and receive any funds <br />or other assistance in connection with projects being or to be undertaken pursuant to those <br />powers. <br />Your Committee Members Hoffmann and Pilago commented on their attendance last month with <br />other dignitaries in the dedication of these parcels. There was a great effort by the County and <br />Legacy Land Conservation Commission in ensuring there are sufficient funds available for the <br />FC Rept. No. 134 <br />
