(A) Protection of the public from the potentially deleterious effects of the <br /> proposed use, or <br /> (B) Fulfillment of the need for public service demands created by the <br /> proposed use. <br /> A. The applicant, its successor or assigns shall be responsible for complying with all stated <br /> conditions of approval. <br /> B. The required water commitment payment shall be submitted to the Department of Water <br /> Supply in accordance with its "Water Commitment Guidelines Policy" within one hundred <br /> eighty(180)days from the effective date of this ordinance. <br /> C. Final Subdivision Approval for the proposed development shall be secured from the Planning <br /> Director within five (5) years from the effective date of this ordinance. <br /> D. Access to the lots shall conform to Chapter 22, County Streets, <br /> of the Hawaii County Code and be limited to Old Government <br /> Road. <br /> E. The applicant shall comply with the following conditions of road improvement: <br /> (1) Improve and dedicate right-of-way width described as follows: A triangular section of <br /> land for a road of right-of-way for intersection improvement to accommodate pavement <br /> turning geometry. This triangular section shall start from the existing southwest corner <br /> of parcel 18 and extend eastward for fifteen feet along the property line ion Homestead <br /> Road,then turn toward the northwest to create the hypotenuse of the triangle which <br /> shall terminate on the south side of the new flagpole driveway on the north side of <br /> parcel 18 at Old Government Road,then turn southward toward the intersection of <br /> Homestead Road and the Mamalahoa Highway. This triangular section shall be <br /> improved by removing encroachments in the road right-of-way including the existing <br /> rock wall and applicant shall add new asphalt pavement to the triangular section and to <br />
