The Honorable J Yoshimoto, Chairman <br /> and Members of the County Council <br /> Page 3 <br /> are not the result of their fault or negligence. The applicant has indicated that the <br /> current reason for non-performance is mainly due to the poor economy. The applicant <br /> has indicated that they have done considerable improvements, including drainage way <br /> bridges, culverts, extensive grading and utility work associated with the project. <br /> The Planning Director does acknowledge that this is the fourth time extension <br /> request and that it has been over 20 years since this change of zone was originally <br /> approved. In reviewing the past time extension requests, the applicant appears to have <br /> made continuous development progress with the exception the exceptional heavy rainfall <br /> event that occurred on October 10, 2006, which caused considerable erosion damage to <br /> the project site. The applicant appears to be committed to finishing the project and there <br /> has been a considerable amount of work done on the project site as well as on-going <br /> efforts to secure the necessary construction and site development approvals from other <br /> affected agencies. <br /> The Planning Director does acknowledge continued progress for the project with <br /> the exception of the recent stall as a result of the poor economy. <br /> Based on the sustained poor economy, it is determined that the applicant could not <br /> have foreseen the economic downturn, which was beyond their control, and not the result <br /> of their fault or negligence. <br /> Approval of this time extension request would not be contrary to the General <br /> Plan,the Zoning Code, or the original reasons for the granting of the Change of <br /> Zone. There have not been any significant changes to the General Plan for this area since <br /> this request was originally approved that would affect this project. The request continues <br /> to be consistent with the General Plan Land Use Pattern Allocation Guide(LUPAG) <br /> Map, which designate this area as Extensive Agriculture. This designation consists of <br /> lands not classified as Important Agricultural Land. It includes lands that are not capable <br /> of producing sustained,high agricultural yields without the intensive application of <br /> modern farming methods and technologies due to certain physical constraints such as soil <br /> composition, slope,machine tillability and climate. <br /> The request is not contrary to Zoning Code. The requested A-3a zoning would <br /> continue to complement the existing A-3a zoning in the area. The requested A-3a zoning <br /> would be compatible with the existing zoning pattern for this particular area. <br /> Lastly,the request is not contrary to the original reasons for granting the change of <br /> zone. At the time of the original application, the request was consistent with the General <br />
