The Honorable J Yoshimoto, Chairman <br />and Members of the County Council <br />Page 10 <br />As part of a condition of approval for the rezoning of the Waikoloa Highlands <br />project, the developer is required to improve the Paniolo Avenue /Waikoloa Road <br />intersection with a roundabout system prior to Final Subdivision Approval of any portion <br />of the project. As Final Subdivision Approval is pending, the roundabout and related <br />improvements have not been constructed. In a separate request from this proposed <br />rezoning, Waikoloa Mauka, LLC has requested an amendment to Condition B of Change <br />of Zone Ordinance No. 07 127 for a five (5) year extension of time to secure Final Plan <br />Approval for fifty (50) lots, provided that Final Subdivision Approval for the entire <br />project be secured within ten (10) years from the new amendment. No action has been <br />taken on this request as of this writing. <br />It is anticipated that upon completion of the roundabout as required under <br />conditions of approval for the Waikoloa Highlands rezoning, the Level of Service (LOS) <br />for the Waikoloa Road /Paniolo Avenue intersection should improve from LOS "B" (short <br />traffic delays) in the morning hours and LOS "C" (average traffic delays) and "D" (long <br />traffic delays) in the afternoon, to LOS "A" (little or no traffic delays). Various <br />conditions of approval will be included as recommended by the Department of Public <br />Works. <br />All utilities and services are available to the site. There is no public water <br />system in this area. The applicant will secure service from the privately owned and <br />operated Hawai`i Water Service Co. Police and emergency services are available in <br />Waimea, and fire services are available on lower Pua Melia Street, approximately a half <br />mile from the project site. <br />The subject request is not contrary to Chapter 205A, Hawaii Revised <br />Statutes, relating to Coastal Zone Management Area. The property is located five <br />miles east or mauka of the Queen Ka`ahumanu Highway and not within the Special <br />Management Area. As such, the project site will not be impacted by coastal hazard and <br />beach erosion. There are no identified recreational resources, public access to the <br />shoreline or mountain areas, designated scenic and open space preserves, coastal <br />ecosystems, marine resources or other natural and environmental resources in the <br />immediate project area. Thus, the proposed request and use of the property will not <br />adversely impact those resources. <br />A draft Archaeological Assessment Report dated July, 2010 prepared by Haun and <br />Associates did not identify any archaeological features or sites within the subject site. In <br />a letter dated October 11, 2012, the DLNR Historic Preservation Division has stated that <br />the survey was accepted by SHPD and no historic properties will be affected by this <br />proj ect. <br />
