6�J~LY C N�I�'' • <br /> COUNTY OF HAWAII STATE OF HAWAII <br /> RESOLUTION NO. 149 13 <br /> RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO <br /> NEGOTIATE A LEASE OF REAL PROPERTY, SITUATED AT <br /> WAIAKEA, SOUTH HILO, COUNTY AND STATE OF HAWAII, <br /> ADJACENT TO ONEKAHAKAHA BEACH PARK, WITH HE OLA <br /> HOU 0 KE KUMU NIU <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII. <br /> WHEREAS, the County of Hawai`i is the owner of that certain real property parcel <br /> adjacent to Onekahakaha Beach Park, described as Tax Map Key: (3) 2-1-014:036 ("Parcel"), <br /> situated at Waiakea, South Hilo, County and State of Hawai`i, delineated on Exhibit "A" <br /> attached hereto; and <br /> WHEREAS,the HE OLA HOU 0 KE KUMU NIU, a not-for-profit organization, <br /> desires to lease the Parcel from the County, for development and maintenance of a Hawaiian <br /> Cultural Center for public education and display that will include crafts of drum and canoe <br /> carving; and <br /> WHEREAS, the facility will be used to teach healthy life skills and ways of <br /> interaction through Hawaiian cultural practices, and to instill mental, physical, and spiritual <br /> well-being within the Hawaiian community, family, and individuals; and <br /> WHEREAS, Section 2-120(a)(2) of the Hawai`i County Code provides that the <br /> Council of the County of Hawai`i may, by resolution approved by a majority of its members, <br /> direct the Finance Director to negotiate the lease of real property to nonprofit organizations, at <br /> such rentals and on such terms and conditions as deemed proper; and <br /> WHEREAS, Section 2-120(b) provides such lease of real property to nonprofit <br /> organizations may be made without the notice or appraisal as required by Chapter 2, Article <br /> 19, of the Hawai`i County Code; now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that <br /> under Chapter 2, Article 19, Section 2-120(a)(2) of the Hawai`i County Code, the Director of <br /> Finance is hereby authorized to negotiate a ten(10) year lease of the Parcel (with additional <br /> renewal options of one (1) year increments) with HE OLA HOU 0 KE KUMU NIU, a not- <br /> for-profit organization, without notice or appraisal, for the real property identified as Tax Map <br /> Key: (3) 2-1-014:036. <br /> BE IT FURTHER RESOLVED,that the Honorable William P. Kenoi, Mayor of the <br /> County of Hawai`i, is hereby authorized to execute said lease agreement on behalf of the <br /> County of Hawai`i following its approval by the Council as noted herein. <br />
