J Yoshimoto, Council Chair <br /> and Members of the County Council <br /> Page 6 <br /> Unclassified on the State of Hawai`i ALISH Map and the Land Use Study Bureau's <br /> Overall Master Productivity Rating for the property's soils is "E" or "Very Poor." <br /> Additionally, the property is not considered important agricultural land and has not been <br /> used for sustained commercial agriculture in the recent past. <br /> The Hawai`i Right to Farm Act, HRS Chapter 165, was enacted to protect farming <br /> operations on land in the State Land Use Agricultural District when adjacent land is <br /> reclassified out of the Agricultural District. A condition of approval will require the <br /> applicant to provide notification to prospective purchasers, tenants or lessees of the <br /> Hawai`i Right to Farm Act. Therefore, the reclassification of this one-acre area from the <br /> Agricultural to the Urban designation will not be detrimental to the agricultural land <br /> inventory in the County of Hawai`i. More importantly, an Urban classification would <br /> complement the existing and future land use pattern of the surrounding area in view of <br /> the urban uses in close proximity to the property. <br /> Based on the above, the approval of the State Land Use Boundary Amendment <br /> from the Agricultural to the Urban District complements the State Land Use District <br /> Regulations and County General Plan and is supportive of the Hawaii State Plan. <br /> Change of Zone <br /> State Land Use Boundary Amendment from Agricultural to Urban and a Change <br /> of Zone from Agricultural - 1 acre (A-la) to Village Commercial - 20,000 square feet <br /> (CV-20) for one-acre of land to accommodate the renovation of an existing 1,200-square <br /> foot warehouse to establish a food processing facility for the preparation of commercial <br /> smoked sausages, meats and fish. The cost of the improvements is approximately <br /> $25,000 and construction will commence upon completion of permitting. <br /> According to the Zoning Code, the purpose of the Village Commercial district is <br /> to provide a broad range or variety of commercial and light industrial uses that are <br /> necessary to serve the population in rural areas where the supplementary support of the <br /> general business uses and activities of a central commercial district is not readily <br /> available. The subject property is located in Pahoa town,the largest town in the area <br /> providing goods and services to the population in rural areas of lower Puna. <br /> The Change of Zone Application from an Agricultural (A-la) to Village <br /> Commercial (CV-20) zoned district will conform to the following goals, policies and <br /> standards of the General Plan. The General Plan is intended to be used as a policy <br /> guide for the coordinated growth and development of all sectors of the County. It sets <br /> forth goals, policies, standards and courses of action to accommodate growth without <br /> congestion, to designate and preserve the lands needed for residential use, commercial <br /> and visitor services, industry, agriculture and open space, and to coordinate these uses <br />
