J�S-4 OF N��1 <br /> COUNTY OF HAWAII STATE OF HAWAII <br /> OF N►' <br /> RESOLUTION NO. 37G 14 <br /> RESOLUTION ACCEPTING THE DONATION OF LOT B-2 SITUATED AT KAIWIKI, <br /> DISTRICT OF SOUTH HILO, COUNTY AND STATE OF HAWAII, BEING TAX MAP <br /> KEY: (3) 2-6-010:067 (POR.), FROM DIANE COPEN FORD AND GARY WILLIAM <br /> VANNATTA <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII. <br /> WHEREAS, Diane Copen Ford and Gary William Vannatta, hereinafter referred to as <br /> "Ford/Vannatta", are the owners of Lot B-2, situated at Kaiwiki, District of South Hilo, County <br /> and State of Hawaii, identified as Tax Map Key: (3) 2-6-010:067 (por.), consisting of <br /> approximately 757 square feet, delineated on Exhibit "1" attached hereto and hereinafter referred <br /> to as "Parcel", and <br /> WHEREAS, it was discovered by Terence Crosson and Mary Ann Crosson, the previous <br /> owners of the Parcel, that the that the County owned paved roadway encroaches upon the Parcel; <br /> and <br /> WHEREAS, Paul H. Murray, Licensed Professional Land Surveyor, conducted a survey <br /> and confirmed the encroachment; and <br /> WHEREAS, Ford/Vannatta wish to donate the Parcel to the County of Hawai'i to <br /> remedy the encroachment for public purpose; and <br /> WHEREAS, such donation has been approved by the Planning Department, Department <br /> of Public Works, Department of Water Supply, Department of Environmental Management, and <br /> the Real Property Tax Division; and <br /> WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter provides that the <br /> Council, on behalf of the County of Hawaii, may accept gifts or donations of real property; now, <br /> therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that in <br /> accordance with Article XI1I, Section 13-12 of the Hawaii County Charter, the County of <br />
