Dru Kanuha, Council Chair <br /> and Members of the County Council <br /> Page 4 <br /> to remove a significant amount of traffic from Kaumana Drive, and finally, Subdivision <br /> 7201 (approved on January 5, 2000) which created the subject lot,permitted a vehicular <br /> access to the subject parcel from Kaumana Drive close to the location of the proposed <br /> access on the applicant's conceptual subdivision plan. It is unknown if this is the best <br /> location for an access from Kaumana Drive, so a condition of approval will allow a single <br /> subdivision access point onto Kaumana Drive and to conduct a site distance analysis to <br /> determine, in conjunction with DPW, the best location for that access. <br /> According to the applicant, an 800-foot stretch of Kaumana Drive is actually <br /> located on the subject property. The applicants entered into an indemnification <br /> agreement with the County of Hawai`i in 1999 over its continued use by the county <br /> without compensation until such time that roadway is resurfaced and the encroachment <br /> can be corrected (see Exhibit A in the Change of Zone Application). The applicants have <br /> stated that they are willing to relinquish this portion of their property in exchange for a <br /> credit against any"Road and Traffic"Fair Share requirement that would be assessed by <br /> the County. Typically the County Council requires that applicants provide a fair share <br /> contribution to mitigate the potential regional impacts of their development on public <br /> facilities and services such as roads and parks. For Family Agricultural (FA) zoning, the <br /> County Council has historically required this contribution for lot sizes of one acre or less. <br /> Therefore, a fair share contribution would not be required for the newly proposed lots as <br /> the applicant is requesting FA-3a zoning. In order to resolve the existing Kaumana Drive <br /> encroachment issue, a condition of approval will require the applicant to create a road lot <br /> to resolve the encroachment during the course of subdividing the property, to then be <br /> dedicated to the County of Hawai`i at no cost. <br /> According to the Department of Water Supply, the subject property is served by <br /> an existing 5/8"meter. Four(4) additional units of county water can be made available <br /> for the proposed subdivision from existing 8-inch waterlines within Country Club Drive <br /> Road and Kaumana Drive fronting the subject property, provided the applicants comply <br /> with servicing requirements and construct necessary water system improvements as <br /> determined by the Depaitnient of Water Supply. A condition of approval will require the <br /> applicants to install water mains (8"minimum diameter of mains from Country Club <br /> Drive) shall be capable of delivering water at adequate pressure and volume under peak <br /> flow and fire-flow conditions and installation of a service lateral to accommodate a 5/8- <br /> inch meter for the additional lots. <br />
