All other essential utilities or services are <br /> available to the property. <br /> There is no severe geological or topographical problem for the property that <br /> cannot be properly rectified or which would render the land unusable. The property is <br /> located in Zone "X", an area determined by FEMA to be located outside of the 500-year <br /> floodplain. Per DPW-Engineering Division's comments, the applicants will be required <br /> to prepare a drainage study and construct a drainage system meeting with the approval of <br /> the Department of Public Works. <br /> To eliminate the potential of additional dwellings on each proposed lot that will <br /> contribute to the cumulative burden on existing infrastructure, a condition is included to <br /> prohibit a second dwelling unit and condominium property regimes on each lot to be <br /> recorded as a covenant in the deeds of all the proposed. <br /> The request is not contrary to Chapter 205A, Hawaii Revised Statues, <br /> relating to Coastal Zone Management Area. The subject property is located over <br /> seven (7) miles from the shoreline and is not in the Special Management Area. Thus,the <br /> property will not be affected by coastal hazards and beach erosion. There are no <br /> identified recreational resources,public access to the shoreline or mountain areas, scenic <br /> and open space preserves, coastal ecosystems, marine resources or other natural and <br /> environmental resources on the subject property. <br /> In view of the Hawai`i State Supreme Court's"PASH" and"Ka Pa'akai 0 <br /> Ka Aina"decisions, the issue relative to native Hawaiian gathering and fishing rights <br /> must be addressed in terms of the cultural,historical, and natural resources and the <br /> associated traditional and customary practices of the site: <br /> • Investigation of valued resources: The Hawai`i State Historic Preservation <br /> Division requested an archeological field inspection on the subject property. In <br /> response, the applicants hired Haun and Associates who conducted the inspection <br /> in August, 2015. Dr. Haun's August 10, 2015 letter report states that, <br /> "The field inspection did not identify any cultural resources or natural lava <br /> formations such as tubes or blisters associated with native Hawaiian burials. <br /> Haun &Associates recommends no further archaeological work based on the <br />
