If previously undocumented sites are inadvertently discovered, <br /> State Historic Preservation Division should be contacted immediately and advised <br /> of the circumstances of the find, its location, and the presence or absence of <br /> associated cultural resources. <br /> • The valued cultural, historical, and natural resources found in the rezoning area: <br /> The property has been previously cleared and is currently in residential and <br /> pasture use. The Department of Land and Natural Resources-Historic As stated <br /> above, an archeological field inspection found no cultural resources. A condition <br /> of the change of zone will require that the applicants cease work and notify the <br /> SHPD should any unanticipated archaeological features or sites be uncovered <br /> during the course of development. <br /> • Possible adverse effect or impairment of valued resources: It is not known <br /> whether the subject or immediate surrounding area was used in the recent past for <br /> gathering purposes by native Hawaiians. There is no evidence that the flora in the <br /> area are particularly desired or used for cultural practices. <br /> • Feasible actions to protect native Hawaiian rights: The applicants, and have not <br /> observed any traditional and customary native Hawaiian rights exercised on the <br /> property. Thus, to the extent to which traditional and customary native Hawaiian <br /> rights are exercised, the proposed action will not affect traditional Hawaiian <br /> rights; therefore, no action is necessary to protect these rights. <br /> Based on the above findings, approval of the Change of Zone request from an <br /> Agricultural—20 acres (A-20a)to Family Agricultural—3 acres (FA-3a) zoned district <br /> would result in an appropriate land use pattern that will further the public necessity and <br /> convenience and the general welfare. <br /> The accompanying draft bill to amend Section 25-8-33 (City of Hilo Area Zone Map) is <br /> provided for your favorable consideration. Please note the proposed conditions of approval are <br /> attached to the draft bill. <br />
