This also confirms conversation between you and <br /> Susan Gagorik of this office on October 30, 1996 clarifying that the request is for <br /> Condition E. <br /> Condition E requires that construction be completed within three years from the effective <br /> date of the ordinance or by January 26, 1997. <br /> Your letter states that delays for the final phase of the project are due to your awaiting <br /> notification from a prospective tenant for one or more build-to-suit units which will <br /> encompass a major portion of the proposed development. <br /> The Planning Director has determined that the non-performance is a result of circumstances <br /> beyond the control of the applicant and not a result of fault or negligence, and hereby grants <br /> you a 3-year extension of time or until January 26, 2000, in which to complete construction. <br /> Please be informed that should you require an additional extension of time, your request with <br /> reasons, 15 copies of your request and a $100 filing fee must be forwarded to this office. <br /> Your request will be forwarded to the Planning Commission who will forward a <br /> recommendation to the County Council. <br /> _ <br /> k:z_ SCANNED I /� <br />
