Plan, there are sites or areas listed as being a scenic resource. The subject site is <br /> not listed as a scenic site. However, there were a few examples cited in the Hilo <br /> area. The most notable is the backdrop of Mauna Kea and the Hilo Bay. <br /> The proposed development would not have any visual impacts on Mauna Kea or <br /> Hilo Bay. The site is located more on the lower end of Mauna Kea and is not <br /> visible from the Highway. Furthermore, the normal residential height of 30 feet <br /> should not interfere with the view of Mauna Kea. <br /> Valued Cultural Resources: <br /> 21. Identify any traditional and customary native Hawaiian rights that are <br /> exercised in the area; the extent in which the proposed development will <br /> affect these rights; and feasible action to be taken to protect native Hawaiian <br /> rights if they exist. In view of the Hawaii State Supreme Court's "PASH" <br /> and "Ka Pa'akai 0 Ka'Aina decisions, the issue relative to native Hawaiian <br /> gathering and fishing rights must be addressed. Specifically, there must be a <br /> discussion of the cultural, historical, and natural resources and associated tradition <br /> and customary practices of this site. <br /> In this situation, the subject site is not adjacent and/or proximate to the shoreline. <br /> As such, gathering of marine life and coastal access is not an issue. <br /> It is not known whether the subject or immediate surrounding area was used in the <br /> recent past for the gathering of plants by native Hawaiians. As the site has been <br /> used for sugar cane in the past, it would appear unlikely that the site would serve <br /> such purpose today. <br /> In the unlikely event that legitimate gathering claims are made by native <br /> Hawaiians, the applicant intends to respect and honor such claims and provide the <br /> needed access within the site. <br /> Based on the above, it does not appear that the project would have any potential <br /> adverse impact relative to the cultural and historical resources of the area. <br /> Public Access: <br /> 22. Existing public access to and along the shoreline or to mountain areas and <br /> knowledge of public access being used: There is no record of a designated <br /> public access to the shoreline or mountain areas that traverses the property. <br /> Social-Economic Characteristics: <br /> 23. Social settlement pattern for the area: There are single-family residences <br /> located south of subject property zoned RS-15. Properties south of subject <br /> properties are zoned AG-1. The area east of subject property consists of natural <br /> vegetation and a single-family residence zoned AG-1. <br /> 7 <br />
