Landscaping shall be provided in accordance with the requirements of <br /> Planning Department's Rule No. 17 (Landscaping Requirements)." <br /> The applicant is requesting a 5-year time extension from the date of approval of <br /> this proposed amendment to complete construction of a proposed six(6) -unit, multiple- <br /> family apartment building with a commercial kitchen on the ground floor. <br /> The non-performance is the result of conditions that could not have been <br /> foreseen or are beyond the control of the applicant, successors or assigns, and that <br /> are not the result or their fault or negligence. The applicant acquired the subject <br /> property in March, 2007, and has stated that since this timeframe coincided with the <br /> economic recession,he was unable to complete construction within the 5-year <br /> construction deadline. Additionally, the applicant is in the process of securing the <br /> required financing to complete the proposed development. <br /> Approval of this request would not be contrary to the General Plan or <br /> Zoning Code nor the original reasons for granting the Change of Zone. There have <br /> not been any significant changes to the General Plan for this area since this request was <br /> originally approved that would affect this project. The property is zoned CV-7.5, is <br /> located within the State Land Use Urban District, and is Designated Medium Density <br /> Urban by the General Plan Land Use Pattern Allocation Guide(LUPAG)map. In <br /> addition,the Kona Community Development Plan (KCDP) was adopted by Ordinance <br /> 08-131 on September 25,2008 by the Hawai`i County Council. The project site is within <br /> the Kona Urban Area and the Kailua Village Redevelopment Transit Oriented • <br /> Development area. Within the Kona Urban Area, growth would be directed to compact <br /> villages located along proposed transit routes or to infill areas within, or adjacent to, <br /> existing development. Based on the preceding, the subject property is consistent with the <br /> intent of the CDP by directing infill growth adjacent to existing development in the Kona <br /> Urban Area. Finally,the subject parcel is located within the Kailua Village Special <br /> District, which means that proposed construction plans are subject to architectural and <br /> design review by the Kailua Village Design Commission which will be required as a <br /> condition of this permit. <br />
