"The applicant shall obtain, if required, a Conditional Letter of Map <br /> Revision (CLOMR) from FEMA for the subject property prior to securing <br /> Final Subdivision Approval or Final Plan Approval, whichever occurs <br /> first." <br /> A portion of the property where the Palai Stream is situated is in FEMA Flood <br /> Zone AE, which is the Special Flood Hazard Area inundated by the 100-year <br /> flood (1% chance of occurring in any given year) where flood elevations have <br /> been determined. In order to develop the property the applicant will need to <br /> construct drainage improvements based on engineered plans that are approved by <br /> FEMA through the issuance of a Conditional Letter of Map Revision (CLOMR). <br /> Once the drainage improvements are completed, the applicant requests a Letter of <br /> Map Revision (LOMR) through the Department of Public Works. Upon approval <br /> of a LOMR, FEMA revises the Flood Insurance Rate Map for the affected area. <br /> Condition G currently requires that the applicant install the required drainage <br /> improvements and secure a LOMR from FEMA before Final Subdivision <br /> Approval or Final Plan Approval, whichever occurs first. The applicant's request <br /> to amend the condition would allow the applicant to subdivide the property or <br /> receive plan approval and construct the required drainage improvements in <br /> conjunction with development of the assisted living facility. Once the site work <br /> for the assisted living facility and drainage improvements are completed, a LOMR <br /> will then be obtained from FEMA based on the completed work. <br /> c. Request for relief from fair share contribution provisions for an assisted living <br /> facility: The applicant is requesting a determination of whether the fair share <br /> contribution requirements in Condition Q apply to assisted living facilities, and if <br /> so, requests relief from the parks and roads contribution components of <br /> Condition Q. <br /> The fair share program was created by the County Council in the 1990's and is <br /> administered by the Planning Department. Condition Q currently requires that the <br /> applicant pay a fair share contribution to mitigate the regional impacts of the <br /> -3- <br />
