BRILHANTE has submitted an application for a Change of Zone from an Agricultural-1 acre (A-1a) to a Single Family Residential-20,000 square feet (RS-20) Zoning district for approximately 50,791 square feet of land. The property is located at 65-1102 Hoku`ula Road, north of the Spencer Road-Held 'ula Road junction, Waimea Homesteads, South Kohala, Hawai`i, TMK: 6-5-004:049. PROPOSED ACTION 1. Applicant's Request: The applicant is requesting to change the zoning district from A-la to RS-20 for a 1.166-acre parcel in order to create a 2-lot subdivision. Upon subdivision, one of the resulting lots will be conveyed to a member of the applicant's family to build a residence. The applicant intends to continue living in the existing permitted dwelling located on the subject property. According to the Zoning Code, the purpose of the Single-Family Residential district is to provide for low and medium density residential uses in areas having facilities. Requirements for establishing a land use in the RS district, including a list of the variety of permitted land uses, are shown in Section 25-5-1 through 8 of the Zoning Code. ;(Planning Department Exhibit 1- Zoning Code Requirements for Single-Family Residential Districts) 2. Reason for the Request: The purpose of the request is to allow the creation of an approximately 22,137 square foot parcel that will be conveyed to a member of the applicant's family. Access to the new parcel is proposed via an electrical and utility easement from Hoku`ula Road. The proposed;second lot will be situated in what is currently the backyard of the applicant's residence and is currently vacant of any use, although it was used intermittently for grazing purposes in the past.
