Poindexter, Council Chair <br /> and Members of the County Council <br /> Page 6 <br /> The project area is serviced by a County sewer system and the dwellings on each of <br /> the subject parcels is currently connected to the sewer. Any future structures will require <br /> connection to the sewer system. In addition, the DEM requires the applicant install a grease <br /> removal device in accordance with the Plumbing Code should they institute a use, such as a <br /> commercial kitchen on the subject parcels. <br /> There is no endangered flora or fauna that will be impacted by the approval of this <br /> amendment request. The Department of Land and Natural Resources-Historic Preservation <br /> Division determined that no historic properties would be affected by the proposed <br /> amendment and there is no evidence of any traditional and customary Native Hawaiian <br /> rights being practiced on the site, nor existence of any known valued cultural, historical or <br /> native resources in the area. <br /> The properties have no severe geological or topographical problems which cannot <br /> be rectified or which would render the land unusable. The project site is located within <br /> Flood Zone "X" and standard conditions related to mitigation of development generated <br /> storm run-off are required. Finally, all necessary utilities and services are available to the <br /> subject properties. <br /> During the review of this application, the Planning Department sought comments <br /> from other government agencies to understand how their rules and regulations impact the <br /> amendment request. To ensure compliance with those regulations, many of the comments <br /> received have been included as conditions of approval in the Planning Director's <br /> recommendation for approval by the Planning Commission and County Council. The <br /> Planning Commission may recommend on the record for this amendment, the addition, <br /> modification or deletion of a portion or all of the language for any of the conditions of <br /> approval. Likewise, the Planning Commission has the authority to forward a favorable or <br /> unfavorable recommendation for this amendment request to the County Council. <br /> Lastly, this recommendation is made with the understanding that the applicant <br /> remains responsible for complying with all other applicable County, State and Federal <br /> governmental requirements in connection with the approved use, prior to and during its <br /> commencement or establishment upon the subject properties. Additional governmental <br /> requirements may include the issuance of building permits, the installation of approved. <br /> wastewater disposal systems, compliance with the Fire Code, installation of improvements <br /> required by the American with Disabilities Act (ADA), compliance with State Health <br /> Department environmental/sanitation/health-related regulations, drainage plan, among <br />
