Chung, Council Chair <br /> and Members of the County Council <br /> Page 5 <br /> including reconfiguring the lot lines (DPW provided a suggested lot reconfiguration), <br /> maximizing sight distance in the selection of the approach locations, implementing access <br /> controls with no-vehicular-access easements, sight distance easements over the adjacent lots <br /> with maintenance required or allowed (or both)by deed covenant and traffic calming <br /> measures. The construction and dedication of the street connection between Lalei Place and <br /> Hane Street to County dedicable standards as well as complying with DPWsight distance <br /> requirements will be added as a condition of this ordinance. <br /> County water is available from an existing 6-inch waterline within Lalei Place which <br /> crosses through the subject parcel. As there is no municipal sewer system in the area, <br /> wastewater will be disposed of through individual wastewater system(s)meeting with the <br /> State Department of Health. Solid waste will be handled through commercial haulers or the <br /> individual homeowners into authorized landfill sites or transfer stations. All essential <br /> utilities such as telephone, cable, and electrical services are available to the site. Police, fire <br /> and medical services are available nearby in Kona. To limit the cumulative impact of the <br /> proposed subdivision on area infrastructure, a condition of approval will prohibit a second <br /> dwelling and condominium property regime on each lot. <br /> There is no severe geological or topographical problems for the property that <br /> cannot be properly rectified or which would render the land unusable. According to <br /> the Flood Insurance Rate Map (FIRM) prepared by the Federal Emergency Management <br /> Agency(FEMA) and the Department of Public Works-Engineering Division, the property is <br /> located in Zone "X", an area outside of the 500-year flood area. The Department of Public <br /> Works, Engineering Division stated that all development generated runoff shall be disposed <br /> of on-site and shall not be directed toward any adjacent properties. Additionally, DPW <br /> recommended a drainage study be prepared for the project and that any resulting drainage <br /> system that is recommended from the study be constructed meeting wth the approval of <br /> DPW. This will be added as a condtion to this ordinance. <br /> The request is not contrary to Chapter 205A, Hawai`i Revised Statutes, relating <br /> to Coastal Zone Management Area. The property is not situated within the Special <br /> Management Area. It is located approximately 3.5 miles from the nearest shoreline and will <br /> not be impacted by coastal hazard and beach erosion. There are no identified recreational <br /> resources or public access to the shoreline or mountain areas, scenic and open space <br /> preserves, coastal ecosystems, marine resources or other natural and environmental resources <br /> in the area. Thus, the proposed request and use of the property will not adversely impact <br /> those resources. It is not anticipated that endangered or threatened candidate species of flora <br /> or fauna are located within the subject property as the site has been grubbed and cleared in <br /> 2003 and 2005 by the applicant and used for cattle grazing. <br />
