Although an Archaeological Inventory Survey <br /> was not prepared for the Property, ASM Affiliates conducted and prepared a <br /> 100% surface field inspection report (October 7, 2016) (Exhibit 5a). By <br /> letter dated January 3, 2017, the Department of Land and Natural Resources, <br /> State Historic Preservation Division issued a "no historic properties affected" <br /> determination for the proposed Project (Exhibit 5b). <br /> C. Amendment Requests to Conditions of Approval. The Applicant is seeking an <br /> amendinent to the following conditions of approval under Ord. 07-105. Deleted text is <br /> [br-aeketed and strieken] and new text is underscored. <br /> 1. Request No. 1 - Time Extension to Condition C (completion of improvements). <br /> C. Construction of the proposed improvements shall be <br /> completed within f ve (5)years ftom the effective date of this <br /> ordinance, as amended. This time period shall include <br /> securing Final Plan Approval f oin the Planning Director in <br /> accordance with the Zoning Code. Plans shall identify <br /> proposed structure(s),fire protection measures, access <br /> roadway, driveway and parking stalls. Landscaping shall be <br /> indicated on the plans for the purpose of mitigating any <br /> potential adverse nice or visual impacts to adjoining parcels. <br /> Landscaping shall be provided in accordance with the <br /> requirements of Planning Department Rule No. 17 <br /> (Landscaping Requirements), Chapter 25 (Zoning Code), <br /> Hawaii County Code. Landscaping shall include rock walls <br /> or fences on the northern boundaries, as agreed upon between <br /> the applicant and landowner of lands adjacent to such <br /> northern boundaries, as may be evidenced by any written <br /> agreements in existence as of the effective date of this <br /> rezoning. <br /> Reason: The Planning Department by letter dated May 8, 2015, granted the prior <br /> developer a five-year administrative time extension within which to comply with <br /> Condition C (time to complete construction) from August 14, 2012 to August 14, <br /> 2017. The prior developer did not proceed with its proposed project and returned the <br /> Property back to the fee owner. <br /> Effective September 2, 2015, the Applicant and the fee owner of the Property, <br /> H. Shiroma, Inc., a Hawaii corporation, entered into a new 15-year Ground Lease. <br /> As the new Lessee and developer of the Property, the Applicant respectfully requests <br /> an additional 5-year time extension from August 14, 2017 to August 14, 2022, within <br /> which to complete construction of its proposed Project. The Applicant anticipates <br /> that construction of the proposed Project will commence shortly after the issuance of <br /> the Final Plan Approval. <br />
