WHEREAS, pursuant to the Hawaii Procurement Code, a committee of <br /> three was formed to review and rate all qualified providers of workers' compensation <br /> services; and, <br /> WHEREAS, LEONG KUNIHIRO BENTON & BROOKE was selected by <br /> the committee as the provider who could best serve the County, based on their <br /> experience and professional qualifications, past performance on projects of similar <br /> scope for public agencies or private industry, capacity to accomplish the work in the <br /> required time, their projected fair and reasonable fees and costs, and the non-existence <br /> of any possible conflicts of interest; and <br /> WHEREAS, the law association of LEONG KUNIHIRO BENTON & <br /> BROOKE was contacted, and agreed to perform said services for the County, <br /> consistent with the terms and conditions as stated herein; and <br /> WHEREAS, pursuant to Section 6-5.5 of the Hawaii County Charter <br /> (2014), the County may, upon authorization by the County Council, employ Special <br /> Counsel for any special matter presenting a real necessity for such employment; and <br /> WHEREAS, on November 3, 2015, the County Council approved the <br /> hiring of LEONG KUNIHIRO BENTON & BROOK for the purpose of providing legal <br /> services to the Department of Human Resources. Health & Safety Division, Workers' <br /> Compensation Branch; <br /> NOW, THEREFORE, the parties agree as follows: <br /> 1. That Special Counsel will render such legal services to and on behalf <br /> of the Department of Human Resources, Health & Safety Division, Workers' <br /> -2- <br />
