And Ms. Torres' appeal was filed to the <br />4 <br />Merit Appeals Board on January 6, 2017. <br />5 <br />Now, we would submit initially that the <br />6 <br />County of Hawai ʻ i, indeed, does have the right to <br />7 <br />investigate possible infractions of the County of <br />8 <br />Hawai ʻ i policies and procedures, which is the subject of <br />9 <br />Ms. Torres' appeal; and the case should be dismissed on <br />10 <br />these grounds alone. <br />11 <br />However, in this case, Ms. Torres also <br />12 <br />invoked the grievance process under the HGEA Collective <br />13 <br />Bargaining Agreement, and that was represented by Union <br />14 <br />Agent Moana Kelii. <br />15 <br />Now, after the investigation of Ms. Torres' <br />16 <br />actions, Ms. Torres was suspended for a total of four <br />17 <br />days for violating the County's internet network and <br />18 <br />e-mail policy. And we had provided to this Board a <br />19 <br />March 10, 2017 letter from Mr. Maeda to Ms. Torres <br />20 <br />which arose out of the November 7, 2016 notice of <br />21 <br />investigation. <br />22 <br />Now, on March 28th, 2017, Ms. Kelii of the <br />23 <br />HGEA submitted a four-day suspension to the grievance <br />24 <br />process, and we have attached that in our reply as <br />25 <br />Exhibit E. <br /> <br />ISLAND COURT REPORTING & TRANSCRIPTION SERVICES <br />(808) 933-9800 <br /> <br />
