Applicants Roger and Linda Clark proposed a sign permit/variance for a 2 square foot <br /> real estate non-illuminating sign with maximum 1.65 inch lettering, and proposed to <br /> place the sign on an entry rock wall with chain link fence, located at the front of their <br /> condominium complex of the Kona West located off of Kuakini Hwy. Commissioner <br /> Sullenberger wanted to make clear that the applicants were selling their condo. Ms. <br /> Newlon (staff) confirmed that the applicants were selling their Condo and want to place <br /> their sign outside of their entry wall. Commissioner Smith asked if dimensions of the <br /> sign were provided. Chairman Roth responded and pointed out that the dimensions were <br /> provided on attachment BC, by the chain link fence indicating that the dimensions were 1 <br /> foot by 2 feet. Commissioner Smith mentioned that he noticed there were <br /> correspondences about the unit owners having difficulty getting in touch with land owner <br /> and asked if there is a requirement that the landowner sign the application. Ms. Newlon <br /> responded saying that even though it is a requirement that the land owner sign the <br /> application, the applicant has been working with the DPW Building and their sign <br /> variance requirements. Commissioner Werchick mentioned this issue is a good example <br /> of something that should not be addressed at the Kailua Village Design Commission. He <br /> suggested that the rule should be amended and should not be subject to a 30 day rule, <br /> because the probability of properties selling within the 30 day rule is minimal and will <br /> bring much expense and difficulty to property owners in this situation. Chairman Roth <br /> agreed with Commissioner Werchick and suggested that in this case it should be <br /> interpreted under the 6 month paragraph and not the 30 day paragraph. <br /> Commissioner Werchick made a motion to approve the extension and Commissioner <br /> Crusat seconded the motion. Commissioner Smith asked Commissioners if the motion <br /> should be that the Building Division confirm the application to be valid, because it lacks <br /> the land owner's signature. Commissioner Werchick responded by saying that it <br /> shouldn't be a KVDC decision. <br /> Ms. Newlon began a roll call vote. Commissioner Werchick made the motion to approve <br /> the application as submitted and Commissioner Crusat, seconded the motion. Voting <br /> began with Commissioner's Ching (Aye), Hetherington (Aye), Ikeuchi (Aye), Kern <br /> (Aye), Smith(Aye), Sullenberger(Aye) and Werchick (Maker of motion). It was a <br /> unanimous vote, the motion was approved. <br /> Chairman Roth—The motion is adopted. <br /> 3. The applicant, Raymond S. Pieri, Project Manager of the Kona Reef <br /> Condominium,is requesting design review of their proposed shoreline area erosion <br /> abatement and property protection project. The project consists of a proposed CRM <br /> wall that would be built entirely along Kona Reef's property in a northwesterly <br /> direction for approximately 220-feet, to be located within 1-foot inland of the State <br /> Certified shoreline. The applicant has applied for a Shoreline Setback Variance and <br /> a Special Management Area Use Permit for this project. <br /> 3 <br />
