NO. 1'SVb <br />1 <br />(1) <br />Changes in market conditions, including supply and <br />2 <br />demand for recycled materials, collection rates, and <br />3 <br />availability; <br />4 <br />(2) <br />The capacity of sorting or processing infrastructure; <br />5 <br />and <br />6 <br />(3) <br />The carbon footprint and other social justice and <br />7 <br />environmental impacts of the production and <br />8 <br />transportation of the recycled material. <br />9 <br />(c) <br />If the department determines that a minimum reuse and <br />10 <br />recycling <br />performance requirement should be adjusted, the <br />11 <br />adjusted <br />requirement shall be in effect until a new <br />12 <br />determination <br />is made or upon the expiration of the minimum <br />13 <br />reuse and <br />recycling performance requirement's effective period, <br />14 <br />whichever <br />occurs first. The department shall not adjust the <br />15 <br />overall minimum <br />reuse and recycling performance requirements for <br />16 <br />all covered <br />products below the requirements established under <br />17 <br />section <br />-13 for the years specified. <br />18 <br />(d) <br />The department may adopt rules pursuant to chapter 91 <br />19 <br />to add or <br />amend material categories to be included in the reuse <br />20 <br />and recycling <br />rate calculations as required in section -13. <br />2021-0546 HB HMSO-1 2,3 <br />
