(a) The department may <br />2 administratively impose a civil penalty of up to $10,000 per <br />3 violation per day on any person who violates this chapter. <br />4 (b) Any person who incurs a penalty under this section may <br />5 appeal the penalty to the department. <br />6 (c) Penalties levied under this section shall be deposited <br />7 in the waste and litter management special fund created in <br />8 section -25. <br />9 § -10 Producer plan; participation; stakeholder input. <br />10 (a) Each producer of covered products shall participate in, <br />11 implement, and fund an approved plan. A producer that fulfills <br />12 its responsibilities under this chapter through a producer <br />13 responsibility organization is responsible jointly and <br />14 severally, and does not assign its responsibilities under this <br />15 chapter to the producer responsibility organization. <br />16 (b) A producer responsibility organization shall not <br />17 include on its board of directors, or otherwise be governed by, <br />18 representatives or affiliates of any public or private entities <br />19 that submit bids to perform work for the producer responsibility <br />20 organization or that contract with the producer responsibility <br />21 organization. <br />2021-0546 HB HMSO-1 25 <br />
