Maile? <br />DAVID:Well, my comment is I believe Mr. TorigoeÓs suggestion tha <br />keep this open and not get into the legal area of whoÓs an expert and whoÓs not -. I think <br />we all can understand that the Native Hawaiian culture, their experts are qualified via <br />different criteria. So my opinion is that if we can all have an equal footing and be able to <br />question each other, like Mr. Torigoe said, I think thatÓs a fair, thatÓs a fair situation for <br />all. And because we being lay people and not well-versed in what the evidence rules are <br />should this go any further, I donÓt want to do anything here at this point and leave our <br />options pretty open and equal. ThatÓs all I have to say. <br />GIFFIN:Mikahala? <br />ROY:Thank you. Again, just for the record of qualifying whether this <br />body comes to the table with ability to discern what is expert in terms of cultural, in other <br />words, would you be able to understand my questioning of a witness such as this with <br />regard to his cultural expertise in relation to his field? Would you be able to understand <br />the depth of those questions is my question to the body. In other words, if you determine <br />later to call in your opinions, the body, this person, what makes up your ability to judge <br />with what relative to what Mrs. David said, you know, balance level way? In other <br />words, IÓm checking for your ability to understand fairly the objections that are brought <br />up for that matter. <br />GIFFIN:Mikahala, I donÓt profess to know everything there is about our <br />culture. But I can tell you that I would be very, and IÓm sure Mr. Torigoe would, as I <br />know him would, give it our very best effort; and thatÓs why we are here, Mr. Togashi, <br />not Mr. Torigoe.
