If I may just ask Mr. Pawu just to verify that <br />the vote, it was a split vote you report, but it was a sufficient affirmative vote to allow you to <br />come here and represent that it is the official action of the Association to offer this withdrawal <br />with conditions? <br />PAWU:Yes, sir, it is. It was specifically, let me get my motions logged here. The <br />movement was to drop the contested case hearing against GW Construction provided that the <br />conditions are included in the special permit, the traffic, the fees, the lot would be used as stated, <br />and that the infrastructure would be in place beforehand. The vote was seconded. The motion <br />was passed by a vote of five for, one opposed, one abstained. <br />TORIGOE:Okay,Ijustwantto,Iguess,verifythatunderyourby-lawsthatfive-four <br />vote would be valid? <br />PAWU:Yes, it would be, the five. There was a quorum present and that was a <br />majority of the vote. And under our bylaws that does give me the authority to be here and <br />testify. And it is the official position of the Board, not necessarily of myself. <br />YUEN:I just want to make sure I heard something correctly. Was it a five to one <br />vote in favor? Youve been saying five for; and I think Mr. Torigoe heard it has five to four. Its <br />five in favor? <br />PAWU:No, Im sorry. Five in favor, one against, one abstention. Im sorry for <br />that lack of clarification. I understand how that could be mistaken there. Five for the project, <br />five in favor of the project, one opposed to the project, and one abstention, oh, the withdrawal <br />Im sorry, not the project but of the withdrawal of the contested case hearing, be precise here. <br />TORIGOE:Okay, thank you.
