Merit Appeals Board <br />April 8, 2022 <br />MS. MATHEWS: The first is on you don't have slide numbers on here. On the Analytics, <br />under Mass Transit Agency, it shows "declined" on the third item. How does somebody decline <br />something that would fall in here? <br />MR. BENNER: So, an issue is brought forward, for example, one question that we ask is, "Do <br />you have"—and I'm not saying that this is necessarily bad but when somebody comes to us, <br />one of things that we ask them is, "Have you filed a union grievance?" If it is an issue that <br />would speak to a union grievance and we're told, "No." But then, when they actually report the <br />issue, we find out that that's a "yes." And so, we wouldn't be in the business of duplicating <br />efforts or establishing parallel process to existing pathways. <br />And so, in that case, we declined the engagement and asked them to keep in contact with us <br />pending that outcome of that to determine if there's more work to be done. That's just one <br />example. <br />CHR. CABANAS: So, in other words, you got to re-route it, right? <br />MR. BENNER: Right. <br />CHR. CABANAS: To the appropriate venue. <br />MR. BENNER: Well, in this case, it was an out of order operations. So, it was the grievance <br />was already filed. So, it—we shouldn't have been drawn on at all while that was in process. <br />MS. MATHEWS: And my second question, actually, goes back to the first under the <br />"Remediation" number "1." When you're talking about testing, could you describe what—how <br />many people are involved in your testing, what your ratios are, et cetera. So, are you looking at <br />three? Are you looking at 100—and over a body of what? <br />MR. BENNER: Let me continue the presentation and, perhaps, I might address that in a future <br />slide. If I haven't, then I will definitely attempt to. <br />MS. MATHEWS: Thank you. <br />MR. BENNER: All right. <br />CHR. CABANAS: Can I ask a question? <br />MR. BENNER: You bet. <br />CHR. CABANAS: So, for the first two listed—Environmental Management and Finance—it <br />says, "County" but not fraud, waste, or abuse—what does that mean? <br />MR.
