therevised or amended Condition 2, we talk about a, the current height limit under the <br />Agricultural zoned district is 35 feet; however, in this particular case because of the concerns <br />regarding viewplanes we have imposed a condition that a maximum height of any structure be 25 <br />feet, and it cannot exceed more than 30 feet. Because you can have a single family structure <br />which meets the height limit of 25 feet but you can have gable that€s much higher than that; and <br />that would fall under the definition of the height, compliance with the height. So we just want to <br />say up to the gable if you want it to go that high it will be no more than 30 feet. And you would <br />have to set back 150 feet from Akoni Pule Highway and also have a 100-foot setback from the <br />ocean or the shoreline. <br />ALAMEDA:Okay, I hear you. Any other questions? This owner was not the original applicant. So when this owner acquired the <br />property, the property had been subdivided with that SMA Minor. The construction drawings for <br />those two cul-de-sacs had been processed, all the agencies had signed off on them. They had <br />actually bid the project out. Willocks Construction was the low bidder. And when Mr. Moody <br />acquired the property, at that time in looking at the cost of it our advice to him was that it <br />exceeded $125,000. And so even though he had a final subdivision approval, we recommended <br />to him that he come back for the SMA Major. So that€s why this occurred the way it did. And <br />4 <br /> <br />
