TYLER:Okay. And I’d like to have that if I can because I think it’s very relative, <br />it’s very relevant to what this Steering Committee of the Kona Community Development Plan <br />has; and I don’t think we’ve ever seen that. <br />ALAMEDA:Sure. <br />TYLER:And make sure, please, you are paying attention to the evacuation <br />flooding; and I think this mauka-makai road, but only one way. In other words, you don’t want <br />it opened. Just, it’s only in time of emergency, and that’s it. Thank you very much. I’d be very <br />happy to answer any questions. <br />ALAMEDA:Thank you. Any questions for Mr. Tyler? Commissioner Salavea? <br />SALAVEA:Thank you, Mr. Chair. Thank you for your testimony, Mr. Tyler. So is it <br />your contention that these sites are actively being used or recent, in recent history have been <br />used? And that’s the reason for the need to identify what type of uses, how frequent and so on, <br />so that they can be considered in the design of this project? <br />TYLER:Well, let me say that, yes, perhaps. I’m not a, I’m not an expert on who <br />may or may not be going on that property or have specific lineal descendancy. I don’t claim <br />lineal descendancy to this property at this point in time. I do claim and will be formally claiming <br />cultural descendancy, which is why Dr. Hahn sent me this stuff. But it’s not enough that <br />somebody is, has done necessarily, just has done it or might be doing it. It has to go much <br />beyond that; and I gave you folks at the last meeting specific information about what was <br />required. I read to you right out of the OEQC Guidelines. And I did this not to create a problem <br />for Mr. Dickler or Mr. Fuke. I did this because I want to be helpful to this Board, to this <br />Commission, excuse me, to make sure that you, that you have an opportunity to consider those <br />things which are legally required to be considered so that we don’t end up in an adversarial <br />relationship; and I’m not suggesting that I’m going to be in that position, Mr. Salavea. I’m just <br />saying it’s much better to be proactive than it is to be reactive, ‘cause then it costs a lot more <br />money and time. So it’s like the trail, you know, whether the integrity of the trail out there is <br />not, is immaterial as to whether or not it’s going to be traditional customary gathering rights, or <br />traditional customary practice would be allowed. And it’s, there are people from this area whom <br />I know that I know, I feel fairly certain, I can’t say I know, but I feel fairly certain would <br />exercise their traditional and customary rights or practice to cultural resources located on this <br />property, as well as above it and in the area. Thank you. <br />SALAVEA:Just to follow-up -. <br />ALAMEDA:Sure, follow-up. <br />SALAVEA:So, and I guess the point I got from your testimony is that the <br />archaeological resources and the cultural practices and resources are related but still, they’re <br />interdependent, but they’re also independent and studies need to be -. Well, we know the <br />archaeological sites have been identified. But the cultural aspect and component of what has <br />been practiced and what might still be, being practiced is independent, and needs to be identified <br />and specified.
