IBBETSON:Can you hear me? The property is listed in the TMKs and I called the <br />Conference Foundation on Oahu and I spoke with Jon Derby. And I asked him if theyd be <br />interested in selling the property. And he said, gosh he wasnt even aware they owned it. And <br />he said let me call you back. And he called me back and said yes Ive spoken with the Directors <br />and theyd be very interested in selling it to you. <br />KRUEGER:Were you aware at the time that you spoke to Mr. Derby initially that there <br />were graves onthe property? <br />IBBETSON:No. <br />KRUEGER:When did you become aware of that? <br />IBBETSON:After speaking with him and his, how do I put this, sounding as if they <br />wouldbeinterestedItoldhimthatIwouldgooverandtakealookattheproperty.AndsoI <br />walked over, I shouldnt say walked, I drove over, I walked down. All that was visible at the <br />time wassiteA. And so I discussed this with Mr. Derby. And he said, thats correct we have, <br />and I you know took it from there and I made an offer and they accepted it. <br />KRUEGER:Did Mr. Derby tell you that he had done anything to communicate or <br />contact the relatives of the decedents who were buried on that property. <br />IBBETSON:No, he didnt say anything to me one way or the other. It was none of my <br />business. I just didnt know what their relationship was with the descendants. <br />KRUEGER:At the time that you purchased this property was there an easement that <br />went beyond the location of the gravesite A the mauka section of gravesite A? <br />IBBETSON:Absolutely not.
